Terms of Use for Holistic Health Tracker

Effective Date: April 30, 2025

By downloading or using the Holistic Health Tracker iOS application (“App”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the App.

1. Eligibility

  • You must be at least 17 years old and capable of forming a binding contract.
  • If using on behalf of an organization, you confirm authority to bind that entity.

2. License and Restrictions

2.1 License Grant

We grant you a limited, non-exclusive, non-transferable license to use the App on Apple devices you own/control, per Apple’s App Store Terms.

2.2 Restrictions

You agree not to:

  • Reverse engineer, decompile, or create derivative works of the App.
  • Use the App for illegal purposes, harassment, or data scraping.
  • Bypass security features or interfere with App functionality.

3. Account and Subscriptions

3.1 Registration

  • Provide accurate information when creating an account.
  • You are responsible for all activities under your account.

3.2 Subscriptions

  • Auto-renewing subscriptions are billed to your Apple ID.
  • To cancel:
    1. Open Settings > [Your Name] > Subscriptions.
    2. Select Holistic AI Health Journal > Cancel Subscription.
  • No refunds for unused periods, except under Apple’s policies or legal requirements.

4. Health and Liability Disclaimers

4.1 Not Medical Advice

  • The App is for general wellness only. It is not a medical device and does not diagnose, treat, or prevent conditions.
  • In emergencies, contact healthcare professionals immediately.

4.2 Data Accuracy

  • User-inputted data (e.g., food, sleep) may be inaccurate. We are not liable for decisions based on this data.
  • HealthKit integration is optional. You can revoke access via iOS Settings.

4.3 Limitation of Liability

We are not liable for:

  • Indirect, incidental, or consequential damages (e.g., lost profits, data loss).
  • Outcomes from third-party services (e.g., Apple HealthKit, UXCam).
  • Unauthorized access to data despite security measures.

5. Intellectual Property

  • All App content (text, graphics, code) is owned by us or licensed from third parties.
  • Third-party trademarks (e.g., Apple, Firebase) belong to their respective owners.

6. Third-Party Services

  • The App integrates with:
    • UXCam (analytics): User analytics to improve app and debug issues
    • Firebase/Google Analytics: Collects usage data under Google’s Privacy Policy.
  • We are not responsible for third-party outages, breaches, or terms.

7. Termination

  • We may terminate your access for violations, fraud, or harmful conduct.
  • You may delete your account/data via Settings > Delete Account or by contacting us.

8. Governing Law and Disputes

  • Governed by Virginia law (U.S.).
  • Disputes resolved via binding arbitration in Virginia (AAA rules). Class actions waived.

9. Changes to Terms

  • Updates will be notified via in-app banners or email.
  • Continued use = acceptance of changes.
